The Town of Niverville has enacted a new Public Property Preservation Bylaw No. 874-25, which combines elements from the former Bylaw No. 685-10, that focuses on maintaining and regulating nuisances or obstructions that impact the safety and ongoing operation and maintenance of municipal roads and drains, and Bylaw 857-23, which aimed to conserve, prohibit, protect, restrict, and regulate the protection, preservation, and removal of trees and vegetation and site alterations on shoreline and site alterations on public or private land within the Town of Niverville.
Added to this new Bylaw are new protocols, such as a resident’s responsibility to maintain boulevards and flankages (with exceptions to this shown on Schedule A of the Bylaw), requirements for non-standard boulevard and flankage treatments, and authorization for other non-standard treatments. This includes permits needed for activities such as the temporary use of public property – such as storing landscaping supplies on Town roads – or accessing private property across public property, such as driving over a boulevard for deliveries.
This bylaw also updates and clarifies rules regarding private improvements on Town property. Residents should be aware that if they choose to place improvements on a Town boulevard or road allowance (for example flowers, driveway borders, or decorative lighting), they become part of Town property. This means that the Town is not responsible for any damage, costs, or replacements that may occur to these improvements.
We also encourage residents to be mindful of other potential bylaw violations, such as:
- Altering grades or drainages that affect the public drainage system;
- Creating or widening a private driveway without securing the necessary permits; or
- Removing bulrushes from retention ponds.
