Council is excited to announce the start of a new initiative called “Last Month at Council”, or LMAC for short!
LMAC will give residents and ratepayers of the Town of Niverville a quick look at what Council passed and approved over the last month, with helpful descriptions of terms that may not be common knowledge.
This is the start of what we hope will be an exciting addition to the Town of Niverville’s communication methods.
Feb. 4th Council Meeting
- Council held a public hearing for and approved a Conditional Use application C2-25 for Lots 1 & 2 Plan 66192 in Fifth Avenue Estates West.
- What was this Public Hearing About? Council held this public hearing regarding a conditional use for the property shown in the map below. The proposed plan for this property is a Planned Unit Development that would have an increased number of residential units than currently allowed under the current zoning requirements which label this property as primarily commercial. As this use class is considered “conditional” under this zone, a public hearing was required.

- What is a Conditional Use? The Manitoba Planning Act describes conditional use as “a use of land or a building that may be permitted under a bylaw”. In the Town Zoning Bylaw, some zones have use cases that are labelled as conditional. This means that if someone wants to use that land or building for that use, they may have to meet certain requirements, and a public hearing is required to be held so that Council can determine if the application should be approved or rejected.
- What is this Property Currently Zoned as? This property is currently zoned as “Commercial Corridor”, which is “intended to serve commercial facilities located outside of a downtown area that require a larger site for high traffic or vehicle-related services and uses requiring direct access to a major arterial street or highway.” In this zone, a Planned Unit Development, such as what is being proposed for the property, is considered a “conditional” class.
- What is a Planned Unit Development? According to the Town of Niverville Zoning Bylaw, a Planned Unit Development is “a land development project planned as an entity in accordance with a unitary site plan that permits flexibility in siting of buildings, mixture of housing types and land uses, useable open spaces and can include the preservation of natural features”. This means that the proposed site plan for the property
- What was Approved? This Conditional Use is specifically regarding the number of proposed residential units that would be allowed on this property, which is above the maximum number currently allowed in this zone. This conditional use has nothing to do with the layout, location, size, number, or height of the buildings proposed. If the developer decides to move forward with this, they would be required to submit an official plan that would also require a public hearing.
- Council passed the new Public Property Preservation Bylaw No. 874-25.
- This bylaw consolidated multiple Bylaws and policies that spoke to the maintenance and preservation of public property. This included sections on topics such as:
- Responsibility of residents to maintain
- boulevards and flankages.
- Standards and permits needed for temporary use of public property.
- Clarification of rules around private improvements on public property, such as driveway borders or flowers placed in the municipal right-of-way.

- This bylaw consolidated multiple Bylaws and policies that spoke to the maintenance and preservation of public property. This included sections on topics such as:
- Council passed an amendment to the Mobile Food Service Units Bylaw No. 871-24. This amendment added requirements for Food Trucks that want to be set up in locations that do not meet setback requirements specified in the bylaw. It also added additional clarification on items such as fees and which businesses are allowed to apply for a license more the twice yearly.
- Council approved an amendment to a subdivision along Balgownie Way (the southwest section of the Highlands) that increased the size of the public reserve in it.
Feb 18th Council Meeting
- Council, after following the Town’s tendering process, awarded the contract for the Town’s Street & Sidewalk Renewal.
- The contract was awarded to Bayview Construction, who submitted the lowest overall bid.
